The "Last Man Standing" rule was overruled in the recent Supreme Court decision (Nuga Nuga Aboriginal Corporation v Minister for Aboriginal and Torres Strait Island Partnerships [2017] QSC 321 (NNAC Decision).

Aro and Geritz (2018) report that, "Legislative amendments to the Aboriginal Cultural Heritage Act 2003 Qld (ACHA) are needed to clarify that it is only where there have previously been determined native title holders that the last claim standing rule does not apply." 

Many Queensland cultural heritage companies are awaiting legislative reform to deal with the disarray.
